Power of Attorney

With a Power of Attorney, you can appoint somebody to manage your affairs on your behalf. There are different types of Power of Attorney depending on where you live, what powers you want to grant, and how long you want someone to manage your affairs for you.

Ordinary or General Power of Attorney

This type is valid only while you still have mental capacity to decide on your financial matters. It's usually only used on a temporary basis, such as if you need to go into the hospital or will be away for some time and need someone to manage your affairs.

Lasting Power of Attorney (LPA)

A Lasting Power of Attorney (LPA) gives your attorney legal authority to make decisions on your behalf if you are unable to, or you don't want to. To set up an LPA, you must have the mental capacity to understand your decision and must not be under any pressure to sign it.

Step 3: Register your Power of Attorney with Office of the Public Guardian

Now your document is complete. If you've created a General Power of Attorney, that's all you need to do – there's no need to register it.

If it's a Lasting Power of Attorney, in order for the document to be legally binding, it needs to be registered with the Office of the Public Guardian, which requires a separate fee.

Once registered, your attorneys can begin to act on your behalf immediately, unless specified otherwise in your Power of Attorney document.
